This week I started my internship at Asylum Access Ecuador (AAE), the reason for the whole trip. AAE, whose headquarters are located in San Francisco in the USA, is a non-governmental organization that offers legal aid to individuals applying for refugee status in Ecuador. Ecuador, by the way, houses the majority of refugees fleeing violence or the threat thereof in Colombia.

My first three days, I participated in a training which was jam-packed with information relevant to the work of AAE. I think it would be boring to discuss all of the details of the different modules, but one noteworthy message of the training was that, though Ecuador has some good legislation regarding refugees (enshrined in the Constitution of 2008, which AAE actually helped to influence) and presents itself as a progressive country in this regard, the situation in practice is another. This is because of contradictory legislation concerning the rights of refugees and the serious discrimination faced by refugees, particularly those from Colombia in Ecuadorian society. Thus, AAE offers legal aid to refugees here so that they can get to know what rights they have (something they often don't know).

AAE fulfills, with the help of both full-time staff and a seemingly steady flow of volunteers, a myriad of tasks. Perhaps the most obvious one is to carry out interviews with people to gather information about their case and to file a legal brief to argue for their recognition as a refugee, according to the definition laid down in the UN Convention of 1951. Yet efugees also come to AAE because other rights are being violated, for example labor rights. Part of this work consists in monitoring and following up on these cases - a sort of quality control. However, as was emphasized during the training, the AAE's aim isn't just to improve one person's life, but rather the lives of thousands. To do this, there is a section of AAE called "incidencia política" (political impact) whose work entails influencing legislation in favor of refugees. This is where I'll be working. AAE has already produced a report on the socioeconomic integration of refugees from the perspective of labor rights, and I (maybe not alone, I'm not sure yet) will be working to produce a new, more detailed document. Work starts tomorrow, so I should have more specifics on that very soon.

W tym tygodniu zacząłem mój staż w Asylum Access Ecuador (AAE), powód tej całej podróży. AAE, której siedziba główna leży w San Francisco w USA, jest organizacją pozarządową, która oferuje bezpłatną pomoc prawną osobom, które mają zamiar złożyć podanie o azyl w Ekwadorze. Ekwador, a propos, przyjmuje większość uchodźców uciekających z powodu przemocy lub zagrożenia przemocą w Kolumbii.

Pierwsze trzy dni brałem udział w szkoleniu, które było przepełnione informacjami istotnymi do pracy w AAE. Myślę, że byłoby nudno dyskutować wszystkie szczegóły z różnych modułów, ale godne wspomnienia w szkoleniu było, że mimo dobrej legislacji dotyczącej uchodźców (zamieszczonej w Konstytucji z roku 2008, na którą właśnie AAE miała wpływ) a także mimo, że rząd prezentuje Ekwador jako bardzo postępowy kraj w sprawie uchodźców, rzeczywistość nie zawsze tak wygląda. To tak przez zaprzeczające ustawy dotyczące uchodźców i poważną dyskryminację, którą uchodźcy przeżywają w społeczeństwie ekwadoriańskim, przede wszystkim ci z Kolumbii. Dlatego AAE oferuje bezpłatną pomoc prawną uchodźcom tutaj, żeby mogli poznać prawa, które mają w Ekwadorze (bo często ich nie znają).

AAE wypełnia różne zadania za pomocą personelu na etacie oraz stałej liczby wolontariuszy. Może najbardziej oczywistym zadaniem jest przeprowadzanie rozmów z klientami o ich przypadkach i przygotowywanie podań, aby walczyć o ich uznanie jako uchodźca, według definicji wprowadzonej w konwencji ONZ z roku 1951. Chociaż uchodźcy też przychodzą do AAE, ponieważ inne ich prawa zostają naruszone, na przykład prawo pracy. Część pracy organizacji składa się z monitorowania i sprawdzania tych przypadków. Jednak, jak podkreślali podczas szkolenia, celem pracy AAE jest poprawa życia nie tylko jednej osoby, ale tysięcy. Aby osiągać to, sekcja AAE, która się nazywa „incidencia política” (wspieranie polityczne), pracuje żeby wpływać na legislację pomagające uchodźcom. Ja pracuję w tej sekcji. AAE już skończył sprawozdanie nt. integracji socjoekonomicznej uchodźców z perspektywy praw pracy, a ja (może nie sam, jeszcze nie wiem) będę pracował, żeby przygotować nowy, bardziej szczegółowy dokument. Prawdziwa praca zacznie się jutro, powinienem znać więcej szczegółów wkrótce.
